Terms and Conditions

These Terms and Conditions (Terms) are a legally binding agreement between you and CrownThrive LLC (CrownThrive, we, us) that governs your access to_types of_ and use of QuizNuggets (the Platform), including the website, web app, admin area, APIs (if enabled), quiz creation and publishing tools, AI-assisted generation, leaderboards, polls, voting, analytics, subscriptions, Share Links, and all related services.

If you do not agree to these Terms, do not access or use the Platform.

0. Definitions
For clarity, the following words have the meanings below:

- Platform: QuizNuggets and all related services, pages, tools, and features.
- User: Anyone who visits, registers, or uses the Platform.
- Creator: A User who creates, uploads, publishes, or manages quizzes, polls, or related content.
- Participant: A User who takes quizzes, votes in polls, views results, or interacts with content.
- Content: Any text, questions, answers, images, files, PDFs, URLs, videos, descriptions, comments, or materials on the Platform.
- Creator Content: Content submitted or published by a Creator.
- Share Links: Any link, QR code, embed link, or URL generated by the Platform that allows quizzes and related pages to be opened or accessed from anywhere.
- AI Features: Any feature that uses artificial intelligence to assist with quiz creation, content processing, categorization, summarization, or related tasks.
- Policies: Any additional rules we publish for specific features (for example: community guidelines, contest rules, sponsor terms, rewards rules, or anti-fraud rules), which become part of these Terms when posted.

1. Acceptance and Updates
1.1 Acceptance
By using the Platform, you confirm you have read, understood, and agree to these Terms.

1.2 Changes
We may update these Terms from time to time. If we make changes, we will update the Effective Date and post the updated Terms. Continued use after changes means you accept the updated Terms.

2. Eligibility and Global Use
2.1 Age
You must be at least 13 years old to use the Platform.

2.2 Minors
If you are under the age of majority in your jurisdiction, you may use the Platform only with consent and supervision of a parent or legal guardian.

2.3 International Use
The Platform may be accessed globally. You are responsible for ensuring your use complies with:
- Local laws where you live or operate
- Industry rules that apply to your organization
- Platform rules and these Terms

2.4 Local Consumer Rights
Some jurisdictions provide non-waivable consumer rights. Nothing in these Terms limits rights you cannot legally waive.

3. Accounts, Access, and Security
3.1 Registration
You may need an account to use certain features. You agree to provide accurate, complete information and keep it current.

3.2 Account Security
You are responsible for:
- Keeping login credentials confidential
- All activity under your account
- Promptly notifying us of suspected unauthorized access

3.3 Identity and Impersonation
You may not impersonate others, misrepresent affiliation, or create accounts on behalf of someone else without permission.

3.4 Administrative Actions
We may take protective actions including:
- Rate limiting
- Temporary access restrictions
- Feature lockouts (for example: AI generation)
- Account suspension
to protect the Platform, users, costs, and integrity.

4. What the Platform Is (and Is Not)
4.1 Platform Purpose
QuizNuggets is an interactive quiz and engagement platform designed for:
- Creators and businesses to publish quizzes and interactive content
- Participants to take quizzes and view results
- Public or private sharing through Share Links

4.2 Not Gambling
QuizNuggets is not presented as a gambling product and is not intended to be used as a game of chance.

4.3 Rewards, Cashouts, and Payouts
If rewards, cashouts, or payouts exist now or in the future:
- They are governed by separate published Policies
- We may impose eligibility checks, verification steps, limits, and enforcement rules
- Until a specific rewards policy is published and active on the Platform, participation is for entertainment, learning, and engagement

5. Share Links, Embeds, and Third-Party Distribution (Critical)
You specifically asked to cover this. This is where many platforms get sued, so we lock it down.

5.1 Share Links Are Distribution Tools
Creators can distribute quizzes using Share Links so quizzes can be opened:
- On the Creator’s websites and landing pages
- On social platforms, email, SMS, QR codes, and ads
- In embedded contexts where supported

5.2 No Guarantee of Universal Compatibility
We do not guarantee Share Links will work on every:
- Browser, device, network, OS, or app
- Third-party platform, email client, or social site
Third parties may block, throttle, rewrite, or sandbox links. That is outside our control.

5.3 Creator Responsibility for Placement
Creators are responsible for where and how they distribute Share Links, including compliance with:
- Third-party platform policies
- Advertising rules and disclosure requirements
- Privacy and consent requirements
- Applicable laws and regulations

5.4 No Endorsement
Sharing a quiz on a third-party site does not mean CrownThrive endorses that site, its operators, or its content. Likewise, third-party placement does not imply partnership unless we explicitly state it in writing.

5.5 Prohibited Sharing and Cloaking
You may not use Share Links to:
- Collect personal data unlawfully
- Mislead users about who created the quiz or where it goes
- Cloak, redirect, or manipulate traffic to evade enforcement
- Distribute illegal, hateful, exploitative, or infringing content

5.6 Link Revocation and Takedowns
We may disable Share Links or remove access to a quiz if:
- The quiz violates these Terms or Policies
- We receive a valid legal complaint
- The quiz creates security, fraud, or reputational risk

6. Subscriptions, Trials, Billing, and Refunds
6.1 Plans
Some Platform features may require a paid plan. Plan limits and pricing are shown in the Platform.

6.2 Trials
If a trial is offered:
- It begins on activation and lasts the number of days shown
- Billing may begin automatically at trial end unless you cancel before it ends

6.3 Auto-Renewal
Subscriptions renew automatically until canceled, unless otherwise stated.

6.4 Billing and Payment Processing
Payments are processed through third-party providers. You authorize us and our providers to charge your payment method for:
- Subscription fees
- Applicable taxes
- Permitted charges (for example: upgrades)

6.5 No Refunds (General Rule)
Except where required by law, subscription fees are non-refundable, including:
- Partial-month use
- Unused quotas or limits
- Account suspensions due to violations

6.6 Chargebacks
If you initiate a chargeback without first contacting support, we may suspend your account and restrict access while we investigate.

7. Acceptable Use (Rules That Keep the Platform Alive)
You agree not to do any of the following:

- Break any law, regulation, or court order
- Attempt unauthorized access to accounts, systems, or data
- Reverse engineer, decompile, or attempt to extract source code where prohibited by law
- Circumvent plan limits, rate limits, or security controls
- Use bots, scraping, automation, or abusive traffic
- Upload malware, harmful code, or exploit vulnerabilities
- Harass, threaten, defame, discriminate, or promote hate
- Post illegal, exploitative, or abusive content
- Misrepresent identity, affiliation, or ownership of content
- Collect personal data from users without lawful basis and consent

8. Creator Content Responsibilities
8.1 You Own Your Risk
Creators are responsible for Creator Content, including:
- Accuracy
- Fairness
- Legal compliance
- Rights clearance
- Audience suitability

8.2 Rights and Permissions
You represent you have all necessary rights to upload and use any Creator Content, including:
- Logos, brand assets, and images
- PDFs and source documents
- URLs and scraped or summarized materials
- Any third-party text or media

8.3 Prohibited Content
You may not publish content that:
- Infringes copyright, trademark, or privacy rights
- Uses personal data without permission
- Promotes illegal activity or dangerous conduct
- Is deceptive or designed to manipulate participants
- Is hateful, harassing, exploitative, or discriminatory
- Targets minors inappropriately or violates youth protection laws

8.4 Accuracy and Ambiguity
Creators must avoid:
- Ambiguous questions without a clear correct answer
- Opinion-based questions presented as factual
- Misleading or culturally exploitative trivia

9. AI Features (Big Disclaimer Section)
AI is powerful. AI is also a confident liar sometimes. We write that into the contract.

9.1 AI Output Is Not Guaranteed
AI outputs may be:
- Incorrect, incomplete, outdated, or biased
- Inconsistent across runs
- Based on limitations of source material

You are responsible for reviewing and verifying AI-generated content before publishing or using it.

9.2 No Professional Advice
AI outputs and Platform content are provided for information and entertainment only and are not legal, medical, financial, or professional advice.

9.3 Input Restrictions
You may not submit:
- Confidential information you are not authorized to disclose
- Sensitive personal data (government IDs, payment card numbers, health data)
- Trade secrets of others
- Content that violates law or third-party rights

9.4 Prompt Injection and Abuse
You may not attempt to:
- Bypass safety or moderation
- Jailbreak AI tools
- Poison prompts or manipulate outputs for harm
- Generate prohibited content or evade enforcement
We may suspend accounts associated with AI abuse patterns.

9.5 Third-Party AI Providers
AI Features may be powered by third-party providers. We are not responsible for:
- Provider outages or latency
- Provider policy changes
- Provider feature limitations
- Output accuracy

9.6 Usage Limits and Cost Controls
To protect performance and costs, we may apply:
- Rate limits
- Plan-based quotas
- File size limits
- Daily caps
Attempting to evade limits is a violation.

10. CrownThrive Framework Alignment and CIE Standards
QuizNuggets operates inside the CrownThrive ecosystem and follows internal operating frameworks for discipline, trust, and scale.

10.1 Convergent Ecosystem and Thrive Flywheel
We may route or coordinate workflows across CrownThrive systems (for example: support, analytics, and operational tooling) to maintain:
- Reliability
- Measurement and reporting
- Fraud prevention
- Scalable operations

10.2 Cultural Imprint Engine (CIE)
We may apply CIE standards to guide:
- Cultural respect and brand safety
- Community integrity and fairness
- Content quality governance
- Sponsor-safe operations

10.3 Enforcement Under Framework Standards
CIE and internal governance standards may be used to justify:
- Content removals
- Share Link disabling
- Visibility restrictions
- Account limitations or suspensions
when content or behavior creates Platform integrity risk.

11. Moderation, Takedowns, and DMCA
11.1 Moderation
We may, but are not required to, review content. We can remove content or restrict access at our discretion to protect the Platform.

11.2 Copyright Claims
If you believe content infringes your rights, contact contact@crownthrive.com with:
- Identification of the protected work
- Identification of the allegedly infringing material
- Your contact information
- A statement of good faith belief
- A statement that your notice is accurate

11.3 Repeat Infringers
We may suspend or terminate repeat infringers.

12. Privacy and Cookies
Your use of the Platform is also governed by the Privacy Policy and Cookie Policy. These describe how we collect, use, and share data.

13. Third-Party Services
The Platform may integrate or rely on third-party services such as:
- Payment processors
- Email delivery providers
- Storage providers
- Analytics providers
- AI providers
We are not responsible for third-party services outside our control.

14. Disclaimers
To the fullest extent permitted by law:
- The Platform is provided on an as is and as available basis
- We do not guarantee uninterrupted or error-free operation
- We do not guarantee content accuracy, including AI outputs
- We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement

15. Limitation of Liability
To the fullest extent permitted by law:
- We are not liable for indirect, incidental, special, consequential, or punitive damages
- We are not liable for loss of profits, revenue, data, or goodwill

Our total liability for any claim related to the Platform will not exceed:
- The amount you paid to us in the 3 months prior to the event giving rise to the claim, or
- $100 if you paid nothing
whichever is greater.

16. Indemnification
You agree to indemnify and hold harmless CrownThrive, its affiliates, and partners from claims, liabilities, damages, losses, and expenses (including reasonable attorney fees) arising from:
- Your use of the Platform
- Your Creator Content
- Your violation of these Terms
- Your infringement of third-party rights
- Your distribution of Share Links in violation of law or third-party rules

17. Termination
17.1 By You
You may stop using the Platform at any time. You may cancel subscriptions through billing settings where available.

17.2 By Us
We may suspend or terminate access if:
- You violate these Terms or Policies
- Your activity creates legal, security, fraud, or reputational risk
- We are required to do so by law

17.3 Effect of Termination
Upon termination:
- Your right to use the Platform ends
- We may remove or disable access to content and Share Links
- Payment obligations accrued prior to termination remain due

18. Governing Law, Venue, and Global Enforceability
18.1 Governing Law
These Terms are governed by the laws of the state or jurisdiction where CrownThrive LLC is organized, without regard to conflict of law rules.

18.2 Venue
Unless prohibited by applicable law, disputes will be brought in the courts located in that jurisdiction, and you consent to personal jurisdiction there.

18.3 International Users
If you access the Platform outside the United States:
- You consent to processing and transfer of information as described in the Privacy Policy
- You remain responsible for local compliance
- Where local law conflicts with these Terms, mandatory local law applies only to the extent required

19. Force Majeure
We are not liable for delays or failures caused by events beyond our reasonable control, including outages, provider failures, cyberattacks, disasters, labor disputes, and government actions.

20. Severability
If any part of these Terms is found unenforceable, the rest remains in effect.

21. Assignment
You may not assign these Terms without our written consent. We may assign these Terms as part of a merger, acquisition, reorganization, or sale of assets.

22. Entire Agreement
These Terms and any posted Policies form the entire agreement between you and CrownThrive regarding the Platform and supersede prior agreements relating to the Platform.
